Plain-language summary

This summary helps you understand the key points, but it does not replace the full text.

  • Workbefy only connects people. It is a technology platform that allows customers, independent service providers and businesses to find and contact each other directly.
  • We are not intermediaries. We do not provide the services, we do not employ or represent providers, we are not a party to any agreements you make, and we do not collect or handle payments between users.
  • You decide on, and are responsible for, your agreements. You agree on the price, the work, the timeline and the payment directly with the other person, at your own responsibility.
  • "Verified" is not a guarantee. It only indicates that the provider's identity document and face were verified with a specialized service (Didit). It does not certify background, skills, licenses or conduct.
  • Do not pay in advance. Check reviews, ask for references and take precautions before hiring.
  • Limitations of liability. To the maximum extent permitted by law, Workbefy is not liable for damage, theft, loss, injury, misunderstandings or disputes between users. This does not limit any rights that the law of your country does not allow you to waive.

1. Who we are

The Workbefy platform (the mobile app, the website workbefy.com and the web platform) is operated by WORKBEFY SRL, a company incorporated in the Dominican Republic, RNC (Taxpayer ID) 1-31-73779-1, with its registered address at Calle Francisco Prats Ramírez No. 224, Evaristo Morales, Santo Domingo, National District, Dominican Republic, commercial registry No. 146853SD ("Workbefy", "we", "us"). Contact: hola@workbefy.com.

2. Acceptance of these terms

These Terms and Conditions (the "Terms") are a contract between you and Workbefy. To create an account you must accept them expressly by checking the corresponding box. If you do not agree with them, do not create an account or use the platform. We keep a record of the version you accepted and the date of your acceptance. You may download or print these Terms from this page at any time.

These Terms are supplemented by the Privacy Policy, which you accept separately, and by the country-specific addenda in Section 29.

3. Age and capacity

You must be at least 18 years old and have the legal capacity to enter into contracts. If you use Workbefy on behalf of a business, you represent that you are authorized to bind it. Accounts may not be created for minors, and minors may not use an adult's account.

4. Definitions

5. What Workbefy is and what it is not

Workbefy is exclusively a technology directory and communication service that allows users to find and contact each other directly. The service Workbefy provides consists solely of giving access to the Platform and its tools (search, profiles, chat, postings, reviews and notifications).

Workbefy does NOT:

Any agreement regarding price, scope, quality, materials, timelines, warranties, method of payment and any other term is exclusively between the Users, who enter into it directly, at their own responsibility and outside of Workbefy.

6. Providers: independence and responsibilities

Providers act on their own account, as independent professionals or workers. No employment, partnership, agency or representation relationship exists between Workbefy and any Provider. Each Provider represents and warrants that:

7. Businesses and job openings

Workbefy is not an employment or placement agency. The Business is solely responsible for its job openings, its hiring process and any employment or service relationship it establishes, and must comply with the labor, anti-discrimination and data protection laws of its country. Workbefy verifies the Business's tax identification number using reasonable means, but does not guarantee its solvency or the fulfillment of its obligations.

8. Your account

9. What "Verified" means

The "Verified" badge (or "Identity verified") only indicates that the Provider's identity document and face (a selfie with a liveness check) were verified with a specialized service (Didit) and, on the date of the verification, appeared to correspond to the same person. For some categories we request an additional document (for example, a certificate of good conduct).

Verification is NOT a certification of criminal background, skills, experience, licenses, insurance, solvency or good conduct, and it may fail to detect false or altered documents. Workbefy is not obligated to verify Users and is not responsible for the accuracy of the information they provide. The "Featured" badge results from the plan purchased by the Provider and is not a recommendation.

10. Your responsibility and precautions before hiring

You are solely responsible for deciding whom you hire, whom you let into your home or business, and to whom you entrust property or the care of people. Before hiring, we recommend that you:

Workbefy displays a safety notice before each contact or hire. Following these recommendations is your decision and your responsibility.

11. Payments between Users

Payments for Provider Services are made directly between Users, outside the Platform, by the means they agree on and at their own expense and risk. Workbefy does not intervene in them, does not process them, does not issue invoices for them and does not handle refunds, warranties, collections or claims between Users.

12. Provider subscriptions

13. Artificial intelligence assistant

The AI Assistant generates automated responses using a third-party artificial intelligence model. Its responses are for guidance only, may contain errors and are not professional, technical, medical, legal or safety advice. Suggestions of categories or providers are not a recommendation or endorsement by Workbefy: the final decision is yours. In dangerous situations (gas, fire, electricity, medical emergencies) call your country's emergency number immediately. Do not enter sensitive data into the assistant. The processing of that data is explained in the Privacy Policy.

14. Content you post

You are solely responsible for the Content you post or send, and you represent that you have the right to do so. You retain ownership of your Content and grant us a worldwide, royalty-free, non-exclusive license, for as long as it remains posted, to host, display and adapt it to the Platform's format and to use it to operate and promote the Platform. Workbefy does not review all Content before it is posted and is not responsible for it, but may remove it in accordance with Section 17.

15. Reviews and ratings

Only Users who had contact with the Provider through the Platform may leave a review, subject to a limit per period. Reviews must be honest and based on real experiences. Fake reviews, paid reviews, reviews in exchange for benefits and self-reviews are prohibited. The Provider may respond once. Workbefy may remove reviews that violate these rules, but does not remove reviews merely because they are negative. Ratings are the opinions of Users, not of Workbefy.

16. Prohibited conduct

The following, among other things, is prohibited:

17. Reports, moderation, suspension and termination

You may report profiles, reviews, messages and job openings from the app. Workbefy reviews reports and may, at its discretion and depending on severity: remove Content; remove the "Verified" badge; hide or mute a profile while it investigates; limit features; or suspend or close an account. It will do so in the event of a breach of these Terms or of the law, a risk to people's safety, fraud, an order from an authority, or use that harms other Users. Where required by law, and unless safety or an investigation prevents it, we will inform you of the reason and you may request a review by writing to our contact email. Workbefy may cooperate with the authorities and provide them with information when required by law.

18. Safety and emergencies

Workbefy is not an emergency or security service. In an emergency, call your country's emergency number (for example, 911). If a User commits a crime, report it to the authorities and report it in the app.

19. Disputes between Users

Any disagreement between Users (regarding price, quality, timelines, damage, payments or any other matter) must be resolved directly between them or before the competent authorities. Workbefy has no obligation to mediate or intervene, although it may do so voluntarily. To the maximum extent permitted by applicable law, you release Workbefy and its partners, officers, employees and contractors from any claim, demand or damage, known or unknown, arising from disputes with other Users or from Provider Services.

20. Platform provided "as is"

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, UNINTERRUPTED OR ERROR-FREE OPERATION, AND ACCURACY OF USER INFORMATION. Workbefy does not guarantee the results you obtain from using it.

21. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  1. Workbefy is not liable for the acts or omissions of Users or third parties, or for Provider Services, including damage to persons or property, theft, robbery, loss, injury, accidents, work that is poorly done, incomplete or late, breaches, non-payment, scams, misunderstandings, misconduct or any situation that occurs between Users, on or off the Platform.
  2. Workbefy is not liable for indirect, incidental, special, punitive or consequential damages, or for lost profits, loss of data, lost opportunities or damage to reputation.
  3. Workbefy is not liable for failures of the internet, devices, app stores or third-party services, or for force majeure events.
  4. Workbefy's total liability to you for any cause related to the Platform will not exceed the greater of (i) the amount you paid us in the 12 months preceding the event giving rise to the claim and (ii) one hundred US dollars (US$100) or its equivalent in local currency.

Legal exception: nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability arising from willful misconduct, gross negligence or harm to life, physical integrity or health caused directly by Workbefy, nor any non-waivable rights granted to you by the consumer protection laws of your country of residence.

22. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify and hold harmless Workbefy and its partners, officers, employees and contractors from and against any third-party claim, demand, penalty, damage, loss or expense (including reasonable attorneys' fees) arising from: your Content; your use of the Platform; your breach of these Terms or of the law; and, if you are a Provider or a Business, the services you provide, the relationships you establish and the legal, tax or labor obligations that are yours.

23. Intellectual property

The Platform, the Workbefy brand, logo, design, software and original text belong to Workbefy or its licensors. We grant you a personal, limited, revocable, non-exclusive and non-transferable license to use the app in accordance with these Terms. You may not copy, modify, decompile or commercially exploit the Platform without written permission.

24. Third-party services

The Platform uses third-party services (for example, Google, Apple, Paddle, RevenueCat, WhatsApp, maps and artificial intelligence providers). Their use is also governed by those third parties' terms, and Workbefy is not responsible for their operation. Links to external sites are provided for convenience and do not imply endorsement.

25. Privacy

The processing of your personal data is explained in the Privacy Policy, which you accept in a separate checkbox when you create your account.

26. Changes to the Platform and to these Terms

We may change or discontinue features of the Platform. We may update these Terms due to changes in the law, the Platform or our business. We will notify you at least 15 days in advance through the app or by other reasonable means, unless the change responds to an urgent legal or security requirement. If the change is material, we will ask you to accept the new version in order to continue using the Platform. If you do not agree, you may close your account at any time.

27. Force majeure

Workbefy will not be liable for failures or delays caused by events beyond its reasonable control, such as natural disasters, pandemics, wars, civil unrest, power or internet outages, failures of technology providers, cyberattacks or decisions of authorities.

28. Governing law and claims

These Terms are governed by the laws of the Dominican Republic. Before making any claim, write to us: we will try to resolve it in good faith within 30 days. Disputes will be submitted to the courts of Santo Domingo, Dominican Republic, without prejudice to the mandatory consumer protection rules of your country of residence, your right to bring a claim before the courts of your place of residence where the law grants you that right, and your right to go to the consumer protection authority of your country (for example, Pro Consumidor in the Dominican Republic, PROFECO in Mexico, the SIC in Colombia or DACO in Puerto Rico). For consumers, arbitration or conciliation will never be the only available route, except as provided in the United States addendum.

29. Country-specific addenda
